1. Agreement to Terms

By accessing and using ClutterCheap.io (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

ClutterCheap.io is a local marketplace platform that connects individuals in the Washington, DC area (within 3km radius) to buy, sell, rent, or receive donated items. We facilitate transactions but are not party to any agreements between buyers and sellers.

2.1 Types of Transactions

  • Sale: Transfer of ownership for monetary payment
  • Rental: Temporary use of items for agreed rental fee
  • Donation: Free transfer of items to community members

3. User Responsibilities

3.1 Sellers Must:

  • Accurately describe items for sale, rent, or donation
  • Upload clear, truthful photos of items
  • Set fair and honest pricing
  • Be available for local pickup coordination
  • Own the right to sell or donate listed items
  • Not list prohibited items (see Section 5)

3.2 Buyers Must:

  • Complete payment through approved methods
  • Coordinate pickup within agreed timeframe
  • Inspect items during pickup
  • Communicate respectfully with sellers

4. Payment Terms

4.1 Accepted Payment Methods

  • Credit/Debit Cards (via Stripe)
  • Apple Pay
  • Google Pay
  • Cryptocurrency (for select transactions)
  • Cash (at pickup, buyer and seller agreement)

4.2 Platform Fees

ClutterCheap.io charges a 5% platform fee on completed transactions (sale and rental only). Donations are free.

4.3 Payment Processing

All online payments are processed securely through Stripe. ClutterCheap.io does not store your payment information. By using our payment services, you agree to Stripe’s terms of service.

5. Prohibited Items

The following items are strictly prohibited on our platform:

  • Illegal items or substances
  • Weapons or ammunition
  • Stolen goods
  • Counterfeit or replica items
  • Alcohol or tobacco products
  • Prescription medications
  • Live animals
  • Hazardous materials
  • Adult content or services

6. Local Pickup Policy

All transactions require in-person pickup within 3km of Washington, DC. We do not offer shipping services.

6.1 Safety Guidelines

  • Meet in public, well-lit locations when possible
  • Bring a friend for high-value transactions
  • Inspect items before completing transaction
  • Trust your instincts – cancel if uncomfortable

7. Refunds and Returns

Summary:

  • Refunds available within 24 hours of pickup if item is significantly misrepresented
  • No refunds for buyer’s remorse or change of mind
  • Rental items: Full refund if item is defective upon pickup
  • Donations: No refunds (items are free)

8. Disputes

If you have a dispute with another user:

  1. First, attempt to resolve directly with the other party
  2. Contact us at support@cluttercheap.io for mediation
  3. Provide evidence (photos, messages, transaction details)
  4. We will review within 3-5 business days

Note: ClutterCheap.io acts as a platform facilitator only. We are not responsible for disputes between buyers and sellers but will assist in resolution when possible.

9. Liability Limitations

ClutterCheap.io provides a platform for local transactions but:

  • We do not verify the accuracy of listings
  • We are not responsible for item quality, condition, or authenticity
  • We are not liable for losses, damages, or injuries from transactions
  • Users transact at their own risk
  • We recommend inspecting all items before completing purchase

10. Account Termination

We reserve the right to suspend or terminate accounts for:

  • Violation of these Terms of Service
  • Fraudulent activity
  • Multiple user complaints
  • Listing prohibited items
  • Abusive behavior toward other users

11. Intellectual Property

All content on ClutterCheap.io, including but not limited to logos, design, text, and code, is owned by ClutterCheap.io and protected by copyright law. Users retain ownership of their listing content (photos, descriptions) but grant us license to display them on our platform.

12. Changes to Terms

We may update these Terms of Service at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the platform after changes constitutes acceptance of new terms.

13. Governing Law

These Terms are governed by the laws of Washington, DC and the United States. Any disputes will be resolved in the courts of Washington, DC.
